A “SPITEFUL” mum faked a DNA test and lied on a birth certificate to block her baby’s biological dad from seeing her, a court heard.
Georgina Saville, 25, is accused of misleading Kyle Fitton, 26, to “derail” his legal bid to see the newborn and another daughter they shared.
The pair had been in a “toxic” four-year relationship, with Kyle moving out shortly after Saville fell pregnant with their second child.
She gave birth to the baby girl in January 2022 but blocked her ex from seeing the newborn, it was said.
When his legal team requested a DNA test from his ex, she sent them bogus results claiming the baby girl belonged to her new boyfriend, jurors heard.
Southampton Crown Court was told the claims came after Saville messaged her mum admitting her two daughters were “full blood sisters”.
She had also text her, saying: “I’m sticking to saying he’s not the dad to this one, I’ve had enough”.
Jurors heard in another text, Saville told her ex: “I’m pregnant with your second child”.
The court was told the pair applied for non-molestation orders against each other following the baby’s birth.
Kyle then started legal proceedings in the Family Court regarding access to his two children and getting his name added to the newborn’s birth certificate.
His eligibility to apply for those orders “depended upon him having parental responsibility” by being the biological dad to both girls, it was said.
When Saville was asked for a DNA test, she at first claimed Kyle was not the dad and that her children had “nothing to do with him”.
But jurors heard she later sent over an apparent test result that claimed her new boyfriend Danny Mellows was the dad.
Prosecutor Nick Tucker said Saville “sought to mislead (Kyle) and his solicitor and, if taken at face value, that test result might have deterred him from pursuing the proceedings any further”.
He added: “We say this was a spiteful and calculated attempt to derail his case by dishonest means.”
In July 2022, another DNA test was ordered by the Family Court that confirmed the baby’s paternity.
Despite this, Saville allegedly went back to the Registry Office and changed the birth certificate to claim Mellows was the father.
Mr Tucker said: “He wasn’t the father. He must’ve known that, and certainly Georgina Saville knew that.
“Knowing that Kyle was the father, she made a false declaration to Births and Deaths, knowing in so doing she would effectively be able to show (Mr Mellows) had parental responsibility whereas (Mr Fitton) would not.”
After she was arrested, Saville claimed biology “didn’t mean anything”, the court was told.
The mum also allegedly admitted providing the “made up” DNA test to save some cash and get her ex “off my back”.
Saville denies perverting the course of public justice and a rare charge of wilfully making a false declaration as to a birth.
